4. How We Share Information
Customs broker confidentiality. As a licensed customs broker, TRIO must follow 19 CFR 111.24. Under that rule, records about our clients' business are confidential. We disclose them only to the client; the client's surety for a particular entry; representatives of the U.S. Department of Homeland Security (including CBP) or other authorized U.S. government officers or agents; in response to a subpoena or court order; or when the client has authorized it in writing. This rule does not apply to information that is properly available from a public source.
We do not sell personal information, and we do not share it for cross-context behavioral (targeted) advertising.
Within those limits, and with written client authorization where 19 CFR 111.24 requires it, we may share personal information with:
-
Government agencies: CBP and Partner Government Agencies, through the Automated Broker Interface (ABI) and the Automated Commercial Environment (ACE) or otherwise, as needed to file entries and other submissions and to respond to government requests.
-
Sureties: the surety on a client's customs bond, for that bond and entry.
-
Service providers that work for us, such as customs filing software providers, website hosting and form providers (Wix.com), our analytics provider (Google Analytics), IT, cloud, email, and document storage providers, and professional advisors such as accountants and lawyers. They may use the information only to provide services to us.
-
Carriers, freight forwarders, other customs brokers or agents, and warehouses, when needed to move or clear goods that a client has asked us to handle, and as the client has authorized.
-
Legal and safety recipients: to comply with law, a subpoena, a court order, or a lawful government request, or to protect the rights, property, or safety of TRIO, our clients, or others.
-
Business transfers: to a buyer or successor in a merger, acquisition, financing, reorganization, or sale of all or part of our business, subject to applicable law, including 19 CFR 111.24.
-
Others, with your consent or at your direction.
5. Data Retention
We keep personal information for as long as we need it for the purposes described in this policy and as required by law. In particular:
-
Customs broker records, including entry records, correspondence, and records of account, are kept for the periods required by CBP regulations, including 19 CFR 111.23 and 19 CFR Part 163, which generally require retention for at least five (5) years after the date of entry. These records are kept in the United States as CBP requires.
-
Powers of attorney are kept as required by 19 CFR 111.23, including after revocation for the period that regulation requires.
-
FTZ, drawback, and other program records are kept for the periods required by the applicable program rules.
-
Website inquiries and quote requests that do not become a client relationship are kept only for as long as needed to respond and as required by law.
-
Website analytics and cookie data are kept as described in Section 6.
Because of these legal requirements, we may not be able to delete records connected to a customs filing when someone asks us to. When we no longer need personal information and the law no longer requires us to keep it, we delete it or de-identify it.
6. Cookies, Analytics, and Similar Technologies
A cookie is a small data file placed on your device when you visit a website. Cookies set by TRIO are "first-party" cookies. Cookies set by others, such as analytics providers, are "third-party" cookies.
The Site uses the following kinds of cookies and similar technologies:
-
Essential cookies, which the Site needs to work, for example for security, form submission, and remembering your cookie choices. These cannot be turned off through the cookie banner.
-
Analytics cookies, which help us understand how visitors use the Site. We use Google Analytics 4. Google explains how it uses data at https://policies.google.com/technologies/partner-sites, and you can opt out at https://tools.google.com/dlpage/gaoptout.
We do not use advertising or marketing cookies on the Site for targeted advertising.
Retention. Cookie and analytics data are kept for the periods set by each provider and by our account settings with that provider, and as required by law.
Your choices. When you first visit the Site, our cookie banner lets you accept or reject non-essential cookies. You can also block or delete cookies in your browser settings; if you delete cookies, the banner will appear again on your next visit so you can make a new choice. Some parts of the Site may not work properly if you block essential cookies.
Global Privacy Control and Do Not Track. We treat a Global Privacy Control (GPC) signal as a request to opt out of the sale of personal information and of sharing for targeted advertising for that browser. Because there is no common industry standard for Do Not Track signals, the Site does not currently respond to them.
7. Data Security
We use reasonable administrative, technical, and physical safeguards to protect personal information, including encrypted (HTTPS) connections to the Site. No website, transmission, or storage system is completely secure, so we cannot guarantee absolute security.
If a security breach affects broker records, we will notify CBP as 19 CFR 111.21 requires. We will also notify affected individuals and others as applicable law requires.
8. Your Choices
-
Marketing emails: Click "unsubscribe" in any marketing email, or contact us (see Section 14). We may still send you service and account messages.
-
Updating your information: Contact us to correct or update your information. Clients can update their importer information on file, and we will submit any required update to CBP (for example, an updated CBP Form 5106) when the client authorizes it.
-
Cookies: See Section 6.
9. Your Privacy Rights
Depending on where you live, and subject to the exceptions in applicable law, you may have the right to: (a) know whether we process your personal information and get a copy of it; (b) correct inaccurate information; (c) delete your personal information; (d) receive your information in a portable format; (e) opt out of the sale of personal information, targeted advertising, and certain profiling; (f) limit the use of sensitive personal information; and (g) not be discriminated against for exercising these rights. Where a privacy law applies to TRIO and to your information, we will honor the rights it gives you as required by that law.
Customs records. Many records we hold must be kept under CBP regulations (see Section 5). We may not be able to delete or change those records. When we cannot fully meet a request, we will tell you why.
Client data. When we hold information about a person because our client provided it to us (for example, a client's supplier or consignee contact), we may refer your request to that client.
How to make a request. Email our Privacy Contact at privacy@triocb.com or call +1.734.219.3306. We will verify your identity before we respond. You may use an authorized agent where the law allows, and we may ask for proof that the agent is authorized. We will respond within the time the law requires.
Appeals. If we decline your request, you may appeal by replying to our decision with "Privacy Appeal" in the subject line. If you are not satisfied with the outcome of your appeal, you may contact your state Attorney General.
10. International Visitors and Data Transfers
TRIO is based in the United States. Your information may be processed in the United States and in other countries where we or our service providers operate. Privacy laws in those countries may be different from the laws where you live. CBP requires us to keep customs broker records in the United States.
11. Children's Privacy
The Site and our services are intended for businesses and adults. They are not directed to children under 16, and we do not knowingly collect personal information from children under 16. If you believe a child has given us personal information, contact us and we will delete it.

13. Changes to This Policy
We may update this policy from time to time. When we do, we will post the updated version on this page and change the "Last Updated" date. If we make material changes, we will give additional notice where the law requires it.
